1. Acceptance of these terms

These Terms and Conditions form an agreement between you and Occupational Medicine Consultants ("OMC," "we," "us"), a Minnesota occupational medicine practice. By accessing this website, requesting an appointment, or receiving services from us, you agree to these terms. If you do not agree, please do not use the site or our services. These terms apply in addition to any consent, authorization, or financial agreement you sign at the time of service; if there is a conflict, the signed document controls.

2. No medical advice; no physician-patient relationship

Content on this website is general educational information about occupational medicine, FAA flight physicals, independent medical examinations, DOT examinations, and related services. It is not medical advice, diagnosis, or treatment, and viewing it, submitting a form, or emailing us does not create a physician-patient relationship. That relationship begins only when a clinician accepts you for evaluation or care in person. Never delay seeking care because of something you read here. In an emergency, call 911 or go to the nearest emergency department.

3. Independent medical examinations and employer-directed exams

An independent medical examination (IME), fitness-for-duty evaluation, or other employer-, insurer-, attorney-, or agency-directed examination is an evaluation, not treatment. In those engagements the examining physician does not become your treating physician, does not provide ongoing care, and generally does not prescribe or manage treatment. The report is prepared for the requesting party, who will receive it, and you will be asked to sign an authorization before the examination. Examinations arising from a Minnesota workers' compensation claim are conducted consistent with Minn. Stat. ch. 176 and applicable Department of Labor and Industry rules. Certification decisions in FAA and DOT examinations are governed by federal regulation and by the certifying agency, and OMC cannot guarantee any certification outcome.

4. Appointments, scheduling and cancellations

• Requests submitted through this website or a third-party scheduling tool are not confirmed until our office confirms them directly.
• Please arrive with valid photo identification, required paperwork, prior records, and any corrective lenses, hearing aids, or medication lists relevant to your examination.
• Please provide at least 24 hours' notice to cancel or reschedule. Missed appointments and late cancellations may be subject to a fee, disclosed to you before it is charged.
• We may reschedule or cancel appointments for clinical, staffing, weather, or safety reasons and will make reasonable efforts to notify you promptly.

5. Fees, billing and payment

Fees for examinations, testing, and evaluations are set by OMC and may change. Many occupational services — including FAA and DOT physicals, IMEs, surveillance testing, and pre-placement exams — are not covered by personal health insurance and are billed to you or to the requesting employer, insurer, or agency. Payment is due at the time of service unless another arrangement is documented. On request, and consistent with Minn. Stat. § 62J.81 and the federal No Surprises Act, we will provide a good-faith estimate of expected charges before scheduled, non-emergency services. Unpaid balances may be referred for collection as permitted by law, and Minnesota debt collection and medical debt protections apply.

6. Communications and consent to contact

By providing a phone number or email address, you consent to receive appointment, results, and administrative messages by phone, voicemail, text, or email. Standard message and data rates may apply, and you may opt out of text messages by replying STOP. Email and text are not fully secure; we limit health detail in those channels and can provide a secure alternative on request. We record your preferred method of contact and honor reasonable requests for confidential communications.

7. Your rights and records

You have the right to considerate and respectful care, to information about your examination, to refuse any procedure, to know the purpose of an examination and who will receive the results, and to obtain copies of your records subject to Minnesota's health records law. Records requests, copy fees, consent requirements, and amendment rights are described in our Privacy Policy and Notice of Privacy Practices. Minnesota patients also have the rights set out in the Minnesota Health Care Bill of Rights, Minn. Stat. § 144.651, where applicable.

8. Acceptable use of this website

• Do not submit false information, impersonate another person, or request records or results on another person's behalf without written authorization.
• Do not attempt to access non-public areas of the site, interfere with its operation, scrape content, or introduce malicious code.
• Do not post or transmit unlawful, harassing, or infringing content through any form or messaging feature on the site.
• Do not send sensitive health information through unsecured web forms or email; call our office instead.

9. Intellectual property

The OMC name, logo, text, graphics, photographs, page design, and other site materials are owned by OMC or its licensors and protected by United States copyright and trademark law. You may view, download, and print pages for personal, non-commercial reference. Any other reproduction, distribution, modification, framing, or republication requires our prior written permission.

10. Third-party links, schedulers and services

This site links to or embeds third-party tools, including online appointment scheduling, mapping, and analytics. Those services operate under their own terms and privacy policies, and we are not responsible for their content, availability, security, or data practices. Your use of a third-party scheduler is at your discretion and subject to that provider's agreement.

11. Accessibility

We work to keep this website usable with assistive technology and to provide accessible facilities, interpreters, and auxiliary aids at our clinic in accordance with the Americans with Disabilities Act, Section 1557 of the Affordable Care Act, and the Minnesota Human Rights Act. If you encounter a barrier on this site or need an accommodation for a visit, contact our office and we will provide the information or service in an alternative format.

12. Disclaimer of warranties

This website is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components. This disclaimer applies to the website only and does not limit the professional standard of care applicable to clinical services.

13. Limitation of liability

To the maximum extent permitted by Minnesota law, OMC and its physicians, employees, and affiliates are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of this website or reliance on its content. Nothing in these terms limits liability that cannot lawfully be limited, including liability for professional negligence, willful misconduct, or any right you have under Minnesota law.

14. Governing law, venue and limitations period

These terms are governed by the laws of the State of Minnesota without regard to conflict-of-law rules. You agree that any dispute arising from this website or these terms will be brought exclusively in the state or federal courts located in Hennepin County, Minnesota, and you consent to personal jurisdiction there. Claims relating to clinical care remain subject to the statutes of limitation and expert-review requirements of Minnesota law, including Minn. Stat. § 145.682.

15. Severability and entire agreement

If any provision of these terms is held unenforceable, the remaining provisions stay in effect and the unenforceable provision is modified to the minimum extent necessary. Our failure to enforce a provision is not a waiver of it. Together with our Privacy Policy and any signed clinical or financial documents, these terms are the complete agreement regarding use of this website.

16. Changes to these terms

We may revise these Terms and Conditions at any time. The current version will always be posted here with its effective date, and continued use of the site after a revision constitutes acceptance of the updated terms.
